The usage of bamoflog services is subject to the following terms and conditions. WE RESERVE THE RIGHT TO MAKE CHANGES ON THIS TERMS FROM TIME TO TIME AND SUCH MODIFICATIONS SHALL BE EFFECTIVE UPON PUBLICATION BY BAMOFLOG.COM IN THE BAMOFLOG WEBSITE. YOU AGREE TO BE BOUND TO ANY CHANGES TO THIS AGREEMENT WHEN YOU USE THE BAMOFLOG SERVICES AFTER ANY MODIFICATION IS POSTED. IT IS THEREFORE IMPORTANT FOR YOU TO REVIEW THIS AGREEMENT REGULARLY TO ENSURE YOU ARE UPDATED AS TO ANY CHANGES.
BAMOFLOG.COM RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO REJECT, REFUSE TO POST OR REMOVE ANY POSTING (INCLUIDING PRIVATE MESSAGES) BY YOU, OR TO RESTRICT, SUSPEND OR TERMINATE YOUR ACCESS TO ALL OR ANY PART OF THE BAMOFLOG SERVICES OR WEBSITE AT ANY TIME, FOR ANY OR NO REASON, WITH OR WITHOUT PRIOR NOTICE AND WITHOUT LIABILITY. BAMOFLOG EXPRESSELY RESERVES THE RIGHT TO REMOVE YOUR SPACE (PROFILE) AND/OR RESTRICT, SUSPEND OR TERMINATE YOUR ACCESS TO BAMOFLOG SERVICES OR WEBSITE IF BAMOFLOG DETERMINES, IN ITS SOLE DISCRETION, THAT YOU POSE A THREAT TO BAMOFLOG AND/OR ITS USERS AND/OR MEMBERS.
1. ELEGIBILITY:
Use of and Membership in the Bamoflog Services is void where prohibited. By using the Bamoflog services, you represent a warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 13 (thirteen) years of age or older; and (d) your use of the Bamoflog services or website does not violate any applicable law or regulation. Your space (profile) may be deleted and your Membership may be terminated without warning, if we believe that you are under 13 (thirteen) years of age.
2. USER BEHAVIOUR:
You agree that you will not make use of the Bamoflog Services for (a) upload, publish or send via e-mail or other way, any content that may be illegal, harming, threatening, abusive, pursuer, obscene, that affects the privacy of the other or is racial or ethnically offensive; (b) act against the security and/or privacy of underages in any way; (c) supplant the identity of any "Bamoflog staff member", or declare and falsify your affiliation with any other person or entity; (d) falsify the origin of any content published using Bamoflog Services or website; (e) upload, publish or send via e-mail or other way any content that in such case, violates any copyright, patent, registered trademark, trademark or other registered rights in which you are not the holder or posess authorization for the use of such material; (f) upload, publish or disseminate any material that may be considered as SPAM or any other way of such unwanted or unauthorised material, computer virus or any other computer code designed to interrupt, damage, destroy, or limit the functionality of any program, hardware or telecom system.
You agree to be bound to have the knowledgy that (a) any uploaded, distribued, published or disseminated material using Bamoflog Services or website is exclusive responsability of the Member that originally made the publication of the content; (b) Bamoflog is not responsible, under any circumstance produced by an error and/or omission for the lost or damage caused by the usage of the Bamoflog Services or website; (c) you should evaluate and contemplate all the associated risks to the use of any Bamoflog service or content.
3. USER GENERATED CONTENT:
You have all the property rights over the content you publish in your space (profile) using Bamoflog services or website. Bamoflog does not claim the property rights of any material that you publish in your space (profile). You are free to make use of your content, online or offline, in any way and in any moment you want. At the time of publishing a content using the Bamoflog services or website, Bamoflog requires a temporal licence to retransmit your content to other members and users.
YOU AGREE TO BE BOUND AND HAVE FULL KNOWLEGDE THAT PUBLISHING CONTENT IN YOUR SPACE (PROFILE), GRANTS A WORLDWIDE LICENCE TO BAMOFLOG, WITHOUT RIGHTS AND NO EXCLUSIVE TO REPRODUCE, MODIFY, DISTRUBUTE, DISSEMINATE AND DISPLAY THE MATERIAL.
Bamoflog resigns by this means to any right to use this licence to (a) produce and sell duplicates of the content directly to individual consumers; (b) produce and sell works derivated or based in the content.
You agree that (a) this licence exists, is valid and applicable while the content remains published in your space (profile) using the Bamoflog services or website, and only for the time that you remain being a Member; (b) this licence will lose validity when you delete or remove the content from your space (profile), or your membership has finished.
4. PASSWORD:
When you sign up to become a Bamoflog member, you will be asked for a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username or password of another Member at any time or to disclose your password to a third party. You agree to notify Bamoflog immediatly if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.
5. MEMBER DISPUTES:
You are solely responsible for your interaction with other Bamoflog Members. Bamoflog reserves the right, but has no obligation, to monitor disputes between you and other Members.
6. COPYRIGHT:
You agree to have the knowledge that all the content created by Bamoflog, its parters or suppliers, that is displayed in this site, incluiding but not limited to, texts, logos, graphic material, images, client-site script, HTML code, server-side script and other software, is property of Bamoflog or its parters or suppliers, and is protected under international copyright laws.
7. TRADEMARKS:
Bamoflog, the Bamoflog pal, Logo and Slogan are registered trademarks in México and other countries. Any other mentioned trademark in the Bamoflog services or website, users' spaces (profiles) or advertisings are either trademarks or registered trademarks of their respective owners.
8. DISCLAIMERS:
Bamoflog.com is not responsible for any incorrect or inaccurate content posted on the Member space (profile) or in connection with the Bamoflog services or website, whether caused by users of the Bamoflog services or website, or by any of the equipement or programming associated with or utilized in the Bamoflog services or website. Spaces (profiles) created and posted by Members on the Bamoflog website may contain links to other websites. Bamoflog.com is not responsible for the content, accuracy or opinions expressed on such websites, and such websites are in no way investigated, monitored or checked for accuracy or completeness by Bamoflog.com. Inclusion of any linked website on the Bamoflog services or website does no timply approval or endorsement of the linked website by Bamoflog. When you access tese third-party sites, yo do so at your own risk. Bamoflog takes no resposibility for third party advertisements shich are posted on, or through the Bamoflog services or website, nor does it take any responsibility for the goods or services provided by its advertisers.
Bamoflog is not responsible for the conduct, whether online or offline, of any User of the Bamoflog services or website. Bamoflog assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any User or Member communication. Bamoflog is nor responsible for any problems or technical malfunction of any telephone network or line, computer online systems, servers or providers, computer equipment, software, failure for any e-mail or players due to technical problems or traffic congestion on the Internet or on any of the Bamofog services or website, or combination thereof, incluiding any injury or damage to Users or ty any person's computer related to or resulting from participation or downloading materials in connection with the Bamoflog services or website. Under no circumstances shall Bamoflog be responsible for any loss or damage, incluiding personal injury or death, resulting from the use of the Bamoflog services or website, attendance at Bamoflog event, from any content posted on or through Bamoflog services or website, or from the conduct of any Users of the Bamoflog services or website, whether online or offline. The Bamoflog services and website are provided on an "as-is" basis and as available, and Bamoflog expressly disclaims any warrant of fitness for a particular purpose or non-infringement. Bamoflog cannot guarantee and does no promise any specific result from use of the Bamoflog services or website.
9. TERM
This agreement shall remain in full force and effect while you use the Bamoflog services or website or are a Member. You may terminate your membership at any time, for any reason, by following the instructions on the Members Home page Account Settings page. Bamoflog may terminate your membership at any time, without warning.
10. LIMITATION ON LIABILITY:
IN NO EVENT SHALL BAMOFLOG BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENDAL, SPECIAL OR PUNITIVE DAMAGES, INCLUIDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE BAMOFLOG SERVICES OR WEBSITE, EVEN IF BAMOFLOG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, BAMOFLOG'S LAIBILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO BAMOFLOG FOR THE BAMOFLOG SERVICES DURING THE TERM OF MEMBERSHIP.
11. APPLICABLE LAW:
This website and its services were created and are updated, maintained and controled by Bamoflog.com in Estado de México, México. Therefore, the mexican laws will rule the limitation on liability, disclaimers, and terms and conditions without starting any conflict between laws. Any lawsuit, sue or legal conflict between Bamoflog and others, shall be processed under the applicable mexican laws.
